Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the StoryPath mobile application (the “Service”) operated by StoryPath (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Eligibility

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you are at least 13 years old. If you are under 18, you must have your parent or legal guardian’s permission to use the Service.

2. Entertainment Purpose Only

IMPORTANT: StoryPath is provided solely for entertainment purposes.

• The Service generates fictional AI-powered audio stories and is NOT a navigation or GPS application
• Route information displayed is for story generation context only and should not be relied upon for actual navigation or travel planning
• Always use dedicated navigation services (e.g., Apple Maps, Google Maps) for actual travel directions
• We make no representations or warranties regarding the accuracy, reliability, or completeness of any route information displayed

3. Safe Usage Responsibility

YOU ARE SOLELY RESPONSIBLE FOR YOUR SAFETY WHILE USING THE SERVICE.

You agree that:

• You will NOT use the Service while operating a motor vehicle unless using hands-free mode and where legally permitted
• You will remain aware of your surroundings at all times whilst using the Service
• You will obey all traffic laws and pedestrian safety rules
• You will use appropriate judgement when selecting routes and locations
• We are NOT liable for any accidents, injuries, or incidents that occur whilst you are using the Service

4. AI-Generated Content Disclaimer

All stories are generated by artificial intelligence and may contain inaccuracies, inconsistencies, or inappropriate content.

You acknowledge and agree that:

• AI-generated stories are fictional and may include factual errors about locations, history, or other subjects
• Story content is generated algorithmically and we do not pre-screen or approve each individual story
• Stories may occasionally contain content that some users may find offensive, inappropriate, or objectionable
• We are not responsible for the accuracy or appropriateness of AI-generated content
• You use AI-generated content at your own risk

5. User Accounts

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms.

You are responsible for:

• Safeguarding the password you use to access the Service
• Any activities or actions under your account
• Notifying us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms.

6. Intellectual Property

6.1 Our Intellectual Property

The Service and its original content (excluding user-generated content), features and functionality are and will remain the exclusive property of StoryPath and its licensors. The Service is protected by copyright, trade mark, and other laws. Our trade marks may not be used in connection with any product or service without our prior written consent.

6.2 AI-Generated Stories

Stories generated through the Service are created using third-party AI technology (Google Gemini). By using the Service:

• You receive a personal, non-exclusive, non-transferable licence to use generated stories for your personal, non-commercial use only
• You may NOT reproduce, distribute, publicly display, or create derivative works from generated stories for commercial purposes
• We retain no ownership rights to the specific content of your generated stories
• However, we reserve the right to use aggregated, anonymised data about story generation for service improvement

7. Prohibited Uses

You agree NOT to use the Service:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate StoryPath, a StoryPath employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
• To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Service

8. Third-Party Services

The Service integrates with and relies upon third-party services including:

• Google Maps Platform (Maps, Places, Directions)
• Google Gemini AI
• Google Firebase
• Google AdMob

Your use of these integrated services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or functionality of these third-party services.

9. Service Availability

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE AVAILABLE AT ALL TIMES.

We reserve the right to:

• Modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice
• Impose limits on certain features or restrict access to parts or all of the Service without notice or liability
• Change, modify, or update these Terms at any time

You agree that we shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

10. Location Services

The Service uses location services to display your current position and to provide location-based story content. By using these features:

• You consent to the collection and use of location data as described in our Privacy Policy
• You acknowledge that location data may be inaccurate or unavailable
• You agree that we are not liable for any consequences arising from inaccurate or unavailable location data

You may disable location services through your device settings, but this may limit Service functionality.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

IN NO EVENT SHALL STORYPATH, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorised access, use or alteration of your transmissions or content
• Any injuries, accidents, or incidents that occur whilst using the Service
• Any inaccuracies in AI-generated content
• Any reliance on route information displayed in the Service

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR AUD $100, WHICHEVER IS LESS.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of MERCHANTABILITY
• Fitness FOR A PARTICULAR PURPOSE
• Non-infringement
• Accuracy, reliability, or availability of the Service
• That the Service will be uninterrupted, timely, secure, or error-free
• That defects will be corrected

13. Indemnification

You agree to defend, indemnify and hold harmless StoryPath and its licensors, employees, contractors, agents, officers and directors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees) arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third party right, including without limitation any copyright, property, or privacy right
• Any claim that your use of the Service caused damage to a third party

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

15. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by our authorised representative.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

17. Dispute Resolution

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by binding arbitration in Sydney, New South Wales, in accordance with the Arbitration Rules of the Australian Centre for International Commercial Arbitration, before one arbitrator appointed in accordance with those Rules.

18. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

19. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination:

• Your right to use the Service will immediately cease
• All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity and limitations of liability

You may terminate your account at any time by using the account deletion feature in the app settings.
